Liability Waiver Template

This is a sample liability waiver template. Please review any country/state/local requirements with your legal counsel and/or insurance provider to confirm your liability waiver is defensible. Consider adding a model release form to your liability waiver as well.

Please read this carefully as this is a legal waiver between you <PARTICIPANT> and <YOUR BUSINESS>

In consideration of my being allowed to participate in any of the <YOUR BUSINESS> <YOUR ACTIVITIES> and/or to use ANY <LIST EQUIPMENT>, I agree to the following waiver and release.

• You acknowledge that you are 18 years of age or older. If you are not 18 years of age or over, a parent or guardian is with you at all times during activities and is signing on your behalf this legal waiver. <REVIEW AND UPDATE IF YOU DO NOT OFFER UNDER 18 CLASSES>
• You acknowledge that <YOUR BUSINESS> is in no way responsible for the safekeeping of your personal belongings while you participate in <YOUR ACTIVITIES>.
• You understand that this event may be physically strenuous and you are voluntarily participating with full knowledge that there is risk of personal injury, property loss or in extreme cases, death.
• You accept all the risks associated with participating with <YOUR BUSINESS> and the facility that hosts <YOUR BUSINESS> activities/events, <NAME OF LOCATION IF RELEVANT>, even if they are created by the carelessness or negligence of a released party of anyone else. (“Released Parties” as used in this document means <YOUR BUSINESS>, <NAME OF LOCATION IF RELEVANT>, its owners, officers, directors, stock holders, managers, employees, contractors, associates, agents, representatives, and assigns). Risks may include physical exertion, wet and uneven surface conditions, temperature extremes, and all potential damages associated with personal injury sustained by a member and/or member’s guest. You know there are other risks that are not listed.
• You release, discharge and waive and claims that you may have, now or in the future, against all released parties even in claims are based on the carelessness or negligence of a released party or anyone else. (“Claims” as used in this document means any and all liabilities, claims, demands, legal actions, and rights of action for damages, personal injury or death that are related to or in any way connect with participate in activities with <YOUR BUSINESS> and <NAME OF LOCATION IF RELEVANT>).
• You agree not to sue released parties for claims, even if the claims arise from carelessness or negligence of a released party or anyone else. You agree to indemnify (reimburse for any loss) and hold harmless each released party from any loss or liability (including any reasonable attorney’s fees that may incur) in defending any claim made or anyone making a claim on your behalf, even if the claim is alleged to or did result from the carelessness or negligence of a released party or anyone else.
• You are aware that there is no obligation for any person to provide medical care to you during the activities. If medical care is rendered, you consent to that care if you are unable to give consent for any reason at the time that the care is rendered.
• You are aware that it is advisable to consult a physician prior to participating in activities. If you have consulted one, you have taken the physician’s advice.

This agreement and any rights, duties and obligations as between the parties to this agreement shall be governed by and interpreted solely in the accordance with the laws of the <WHERE YOUR BUSINESS IS BASED> and no other jurisdiction, and any litigation involving the parties to this agreement shall be brought solely within <WHERE YOUR BUSINESS IS BASED> and shall be within the exclusive jurisdiction of the Courts of <WHERE YOUR BUSINESS IS BASED>.

In entering this agreement, you are not relying on any oral or written representations or statements made by <YOUR BUSINESS> other than what is set for in this agreement.

By signing this waiver, you agree that: I have read and understand this agreement and I am aware that by signing this agreement I am waiving certain legal rights which I or my heirs, executors and legal representatives may have against <YOUR BUSINESS>. I understand and intend that this document acts as the broadest and most inclusive assumption of risk, waiver, release of liability, agreement not to sue and indemnify as permitted by the laws of <WHERE YOUR BUSINESS IS BASED>
